What Every Teacher Must Know About POCSO

एक बच्चा अपने जीवन के
लगभग 8 घंटे स्कूल में
बिताता है।
A child spends nearly 8 hours a day at school, more waking
hours with teachers than with parents. That makes every teacher not just an
educator, but a guardian.
Yet a 2024 study published in PMC (National
Institutes of Health) found that awareness of POCSO provisions among
school educators in India remains inconsistent, ranging from 60% to 80% across
key domains. The gap in that remaining 20–40% is where children fall through
the cracks.
The Protection of Children from Sexual Offences Act, 2012, commonly known as POCSO, is not just a law for lawyers and courts. It is a law that lives or dies in the classroom. And every teacher, whether in a CBSE school in Delhi or a State Board school in a small town, has a legal and moral role to play.

The POCSO Act was enacted by the Government of India to
provide a comprehensive legal framework protecting all children below 18 years
from sexual abuse, harassment, and exploitation. It covers physical, verbal,
and online offences, and establishes child-friendly procedures for reporting,
investigation, and trial.
Importantly, the Act is gender-neutral; it protects all children, regardless of gender.

Every Teacher Must Know
1. बच्चे की परिभाषा | Definition of a Child
POCSO के
अनुसार, 18 वर्ष से कम
आयु का प्रत्येक व्यक्ति
बच्चा है।
Under POCSO, every person under 18 is a child. Every single
student in your classroom is covered under this Act, no exceptions.
2. अपराधों के प्रकार | Types of Offences
The Act recognizes a wide spectrum of abuse:
- Penetrative
and non-penetrative sexual assault
- Sexual
harassment (including verbal and online)
- Use
of children for pornography

Even acts that may seem "minor", an inappropriate
touch, a sexually coloured remark, are punishable under the law.

This is arguably the most critical provision for teachers.
If you have knowledge or even suspicion that
a child is being abused, you are legally required to report it, to the local
police station or the Child Welfare Committee (CWC). This is not optional. This
is not a matter of "waiting to be sure."

Failure to report is itself a punishable offence under the Act.

The law mandates sensitive handling of child survivors
during investigation and trial. As a trusted adult, your role is to reassure
the child, not interrogate them. Do not push for details. Do not
express disbelief. Your job is to listen and report.
5. पहचान की सुरक्षा | Protection of Identity
बच्चे
की पहचान, उसका नाम, फोटो,
स्कूल, पड़ोस, किसी भी सार्वजनिक

Disclosing the identity of a child survivor, name, photo,
school, or neighbourhood, in any public forum is a criminal offence. This
includes social media. Confidentiality is not just ethical; it is mandatory.
6. रोकथाम में शिक्षक की भूमिका | The Teacher's Role in Prevention
Beyond legal compliance, teachers are agents of prevention.
This means:
- Teaching
children about "safe touch" and "unsafe touch" in
age-appropriate ways
- Creating
a classroom environment where children feel safe to speak up
- Building
enough trust that a child would choose to come to you if
something felt wrong

If a child discloses abuse or you suspect it, follow these
steps:
- Stay
calm. Your reaction shapes whether the child continues to trust
you.
- Do
not confront the alleged abuser yourself.
- Report
immediately to the nearest police station or call the Childline
helpline: 1098 (free, 24/7).
- Inform
your school principal, but remember, reporting to the school does not replace
your legal duty to report to the police or CWC.
- Document what the child said, in their own words, as accurately as possible.

A 2024 research study in India found that teachers with
structured POCSO training were significantly more likely to identify warning
signs early and report correctly. Awareness is not passive, it is a skill that
must be built, practised, and updated.
